Warranty, Returns & Australian Consumer Law
Products sold by Marine Depot may be covered by a manufacturer or distributor warranty. Warranty periods, conditions and exclusions vary depending on the product, brand and supplier. Some manufacturer or distributor warranties may exclude commercial, industrial, hire, racing or non-recreational use.
Manufacturer and distributor warranties are provided in addition to any rights you may have under the Australian Consumer Law. They do not limit, replace or exclude any consumer guarantees that apply.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Warranty and Fault Claims
If you believe a product is faulty, damaged, defective or not performing as expected, please contact Marine Depot with your proof of purchase and supporting information.
Depending on the product and issue, we may request photos, videos, installation details, serial numbers, batch numbers, product labels, usage details, or return of the item for inspection. We may also refer the matter to the manufacturer, distributor or supplier for technical assessment.
Where a manufacturer or distributor warranty applies, we will assist with the claim process. Where a product is outside the manufacturer/distributor warranty period, or where the manufacturer/distributor warranty excludes the type of use, Marine Depot may still assess the matter under Australian Consumer Law where applicable.
A claim may not be accepted where the issue is caused by misuse, incorrect installation, accident, impact, modification, unauthorised repairs, negligence, lack of maintenance, normal wear and tear, unsuitable application, environmental exposure outside product specifications, chemical damage, incorrect storage, or failure to follow manufacturer instructions.
Products used in harsh marine, watersports, racing, commercial, hire or high-impact environments may be subject to greater wear, stress and environmental exposure. Damage resulting from normal participation, impact, overloading, improper use, unsuitable application, lack of maintenance, or environmental exposure outside the product specifications may not be covered by warranty.
Commercial Use
Some products are supplied with manufacturer or distributor warranties that apply only to private or recreational use and exclude commercial, hire, industrial, racing, trade or non-recreational use. Where this applies, the manufacturer or distributor may decline an express warranty claim.
This does not automatically exclude any rights that may apply under the Australian Consumer Law. Business purchasers may still have consumer guarantee rights in some circumstances, including where the goods or services are within the ACL monetary threshold and are not acquired for resupply or another excluded purpose.
Commercial-use claims may require additional assessment, including details of installation, operating conditions, maintenance, product application, usage frequency and usage environment.
Damaged, Incorrect or Missing Items
If you receive an incorrect item, missing item, or an item damaged in transit, please contact us as soon as possible, preferably within 24 hours of delivery. Prompt notification helps us investigate with the courier, supplier or warehouse.
We may require photos of the packaging, shipping label, damaged item, incorrect item, or other supporting evidence so we can investigate and resolve the issue.
Proof of Purchase
Warranty, fault and consumer guarantee claims require proof of purchase. This may include your Marine Depot order number, tax invoice, receipt or other purchase confirmation.
Unauthorised Repairs or Modifications
Claims may not be accepted where the product has been modified, altered, repaired or tampered with without prior approval from Marine Depot, the manufacturer, distributor or authorised repair agent.
Return Shipping for Warranty or Fault Claims
Where Marine Depot determines that a product should be returned for assessment, repair, replacement or refund, we will advise the return process.
In many cases, Marine Depot may provide a return consignment note for an approved warranty or fault assessment. If a customer is required to pay return freight for a valid warranty or consumer guarantee claim, reasonable return shipping costs may be refunded.
Marine Depot is not liable for inbound returns that are lost in transit where the customer arranges their own return shipping. We recommend using a tracked service and keeping proof of lodgement.
Refunds, Repairs, Replacements or Credits
The remedy offered will depend on the nature of the issue, the product, the assessment outcome, the manufacturer or distributor’s position, and any rights that apply under the Australian Consumer Law.
Where a valid warranty or consumer guarantee claim is approved, the product may be repaired, replaced, credited or refunded depending on the circumstances.
If a refund is approved for a valid warranty or consumer guarantee claim, original standard shipping charges may also be refunded where required by law.
